O-Cedar Prize Draw

• These terms and conditions (“T&C”) are applicable to O-Cedar Flex & Catch duster product giveaway through a random drawing for a prize as set out herein (the “Prize Draw”), which is a promotional game of chance (‘sweepstake’) that can be entered with no purchase necessary. The Prize Draw is provided by O-Cedar, legal form and address of the company, registration number.
• To the extent there is a conflict between these T&C and terms and conditions appearing on any other location in respect of this Prize Draw, these T&C prevail.

Conditions for participation

• No purchase is necessary to enter or win the Prize Draw and any purchase or payment will not improve your chances of winning.
• Any natural person residing in the United States who is, at the time of entry, at least eighteen (18) years old, is eligible to participate in the Prize Draw. To participate in the Prize Draw, such eligible person must take each of the following actions: (i) rate us, e.g. post a "like" on the social media post in relation to O-Cedar (on Instagram or Facebook); and (ii) on Instagram only, leave a comment with an item you love but dread dusting on the Post. On Facebook and Instagram, fans can earn an additional entry by also sharing the post on their Story or Feed.
• The giveaway runs from June 10, 2024 through June 14, 2024. Five winners will be selected per channel at the conclusion of the contest. Any entries by a Contestant in excess of the initial entry shall be excluded from the Prize Draw without notice.
• By participating in the Prize Draw each Contestant agrees to be bound fully and unconditionally by these T&C and any of O-Cedar’s decisions in relation to the Prize Draw, which are final and binding in all matters related to the Prize Draw. Winning a prize is contingent upon fulfilling all requirements set forth in these T&C.
• All entries become the sole property of O-Cedar. No confirmations of receipt of entries will be issued. O-Cedar is not responsible for telecommunications, network, electronic, technical or computer failures or any kind of lost, late, incomplete, mutilated, invalid, unintelligible, misdirected entries. Only fully completed entries with valid and legitimate social media accounts are eligible. All ineligible entries will be disqualified in accordance of these T&C. O-Cedar  accepts no responsibility for any late or ineligible entries, or any entries not received for whatsoever reason.

Designation of winner

• Without prejudice to the conditions for participation in the Prize Draw, one Contestant will be selected from the pool of all eligible entries per channel, per day and designated as winner (the “Winning Contestant”), it being understood that the Winning Contestants will be eligible to receive the Prize (as defined below). The winning entry will be selected by an external tool that is able to designate a winner in an impartial manner based on random selection. A win may be subject to disqualification in accordance of these T&C. Winners will be selected at the conclusion of the contest. No Contestant can or needs to be present at the draw.
• The Prize Draw will have ten (10) Winning Contestants (5 on Instagram, 5 on Facebook), who will be granted a prize in the form of one (1) O-Cedar Flex & Catch Heavy Duty Dusting Kit, Flex & Catch refills, and other O-Cedar products.
• If any Prize is unavailable for whatever reason, O-Cedar reserves the right to substitute that Prize for an alternate prize of equal or greater value, subject to applicable law.

Tax liability of the Winning Contestant in relation to accepting the Prize

• The Winning Contestant should seek independent financial advice prior to acceptance of the Prize to determine if any tax implications may arise from his/her/their prize winning (including but not limited to taxes and customs duties).
• Any liability, duty and obligation in relation to any Prize, whether present or future, actual or contingent, ascertained, unascertained or disputed, to make or suffer an actual or increased payment of any form of taxation (including penalties relating thereto) to any tax or other authority, is in any event for the account of the Winning Contestant who accepted the Prize. For the avoidance of doubt, O-Cedar shall not be responsible for any liability or tax implications that may arise in connection with the Winning Contestant accepting any Prize.

Announcement of the winner and acceptance of the Prize

• The Winning Contestants will be announced by O-Cedar by notifying the Winning Contestants via a direct message from the appropriate O-Cedar social media account to the social media account used by the Winning Contestants for purposes of participating in the Prize Draw. The Winning Contestants will have been deemed to have been notified on the earlier of (i) the moment the Winning Contestant receives and views the notification from O-Cedar  or (ii) forty-eight (48) hours after the notifying message was sent by O-Cedar  to the Winning Contestant. O-Cedar  has no liability for a Winning Contestant’s failure to receive notices due to filters, security settings or provision of incorrect or non-functioning contact details.
• O-Cedar will grant the Winning Contestant access to the Prize through a direct message from the appropriate O-Cedar social media account to the social media account used by the Winning Contestant for purposes of participating in the Prize Draw, provided that the Winning Contestant has complied with all requirements as set out in these T&C. O-Cedar  is not responsible for any lost or stolen prizes and O-Cedar  is not responsible for prizes damaged, delayed or lost in transit.

Liability cap and release plus indemnification

• The Winning Contestants acknowledge and agree that except where permitted by law, the total cumulative liability of O-Cedar in connection with the Prize Draw and the related promotion is limited, in O-Cedar’s discretion, to either resupplying the Prize, or paying the cost of resupplying the Prize. O-Cedar  will have no liability for any consequential or indirect loss or damage suffered by any Contestant or any Winning Contestants.
• Except where unable to be excluded by law, Contestants and the Winning Contestants release and indemnify O-Cedar and its affiliates from and against all actions, penalties, liabilities, claims or demands against O-Cedar  or that O-Cedar  may incur for any loss or damage which is or may be suffered or sustained as a direct or indirect result of (i) a Contestant entering or winning the Prize Draw, (ii) a Contestant accessing O-Cedar’s  website, (iii) the receipt, ownership, possession, use or misuse of any Prize awarded, (iv) viruses or any downloading or other problems in connection with the Prize Draw; or (v) any typographical or other error in these T&C or the announcement of offering of the Prize.
• The Winning Contestants bear all liability and risk of loss or damage to his, her, or their Prize after this has been delivered.

Use of personal data

• O-Cedar will use any data submitted by any person in relation to the Prize Draw in accordance with O-Cedar’s  Privacy Statement and for the purposes of the Prize Draw. By participating in the Prize Draw, each Contestant consents to the use of its personal data by O-Cedar  for the purposes of (a) the administration of this Prize Draw, (b) publicly announcing the Winning Contestants (in O-Cedar’s  sole discretion) and (c) sending such person direct marketing messages on O-Cedars  behalf, including, at O-Cedar  instruction, by O-Cedar  affiliates, marketing agencies and/or third parties; and (d) any other purposes to which the Contestant has consented when participating in the Prize Draw.
• The Winning Contestants' acceptance of any Prize constitutes permission (except where prohibited) for O-Cedar to use the Winning Contestant’s name, social media handle, photograph, video footage, likeness, statements, biographical information, voice and address (city and state) for any and all public relations, advertising and/or promotional purposes as determined by O-Cedar , in all forms of media and by all manners (now and hereafter known), in perpetuity, without notice, consent, review or approval or further compensation.

No other sponsors

• This Prize Draw is in no way sponsored, endorsed, or administered by or associated with (i) Instagram, Messenger, Meta (Facebook), Twitter, TikTok or any other social media platform, or (ii) any other brand. Each Contestant acknowledges that all information and materials that such Contestant submits to enter this Prize Draw is submitted to O-Cedar via the social media account and not to (i) Instagram, Messenger, Meta (Facebook), Twitter, TikTok or any other social media platform or (ii) any fashion brand. Each Contestant agrees that (i) Instagram, Messenger, Meta (Facebook), Twitter, TikTok, any other social media platform and (ii) any other brand, shall not be liable in any way to such Contestant in respect of the Prize Draw. Each Contestant fully releases and discharges (i) Instagram, Messenger, Meta (Facebook), Twitter, TikTok or any other social media platform and (ii) any fashion brand, from and relinquishes all rights, claims and actions that such Contestant may have or acquire against any such party.

Non-Affiliation Notice and Disclaimer

• Neither FHP nor the O-Cedar brand hold itself out as the manufacturer, an affiliate of the manufacturer, or an “authorized” distributor of the products being given away as part of this giveaway. Recipients of this product through this giveaway may not be guaranteed services, including training and technical support that may otherwise be available or provided by the manufacturer. Further, the manufacturer’s warranty, if any, potentially associated with the products given away as part of this promotion may not be honored by the manufacturer.  FHP provides this disclaimer to ensure there is no likelihood of confusion unduly influencing your decision to enter this giveaway, and to ensure there is no confusion as to the existence of any affiliation between FHP and the manufacturer of the products being given away as part of this giveaway.

Disqualification

• O-Cedar has the right to disqualify each Contestant or Winning Contestant whose participation in the Prize Draw, in O-Cedar’s sole determination, does not comply or has not complied with these T&C or who, in O-Cedar’s  sole determination, has acted in a manner that is fraudulent, dishonest or unjust to any other Contestant(s) including, but not limited to, tampering with the operation of the Prize Draw,  manipulating the entry process by using multiple or fake accounts, hacking, deceiving, cheating, harassing or threatening any other Contestant(s) or a representative(s) of O-Cedar .

Suspension or cancellation of the Prize Draw

• Subject to the approval of any relevant authorities, in the event the Prize Draw is incapable of running as planned for whatever reason (including, but not limited to, early deletion of the campaign post due to any third party software, early or accidental deletion of any campaign posts by any other person, any outage of any social media accounts, war, terrorism, state of emergency or disaster (including natural disaster), infection by computer virus, bugs, tampering, unauthorised intervention, technical failures which corrupt or affect the administration, security, fairness, integrity or proper conduct of the campaign, any alteration to any social media terms of service, access or permission in such a way that adversely affects the Prize Draw), O-Cedar may, in its sole discretion, suspend the Prize Draw for the duration of the event, cancel or recommence the Prize Draw in its entirety.

Communication costs

• There are no communication costs imposed on the Contestants for participating in the Prize Draw.

Further Information and complaints procedure

• A copy of these terms and conditions is made available to each Contestant free of charge upon request and any other information in relation to the Prize Draw can be obtained by sending an email to ocedarsocialmedia@fhp-ww.com. Any complaints about the Prize Draw can be submitted to ocedarsocialmedia@fhp-ww.com and O-Cedar aims to respond to, and to the extent possible resolve, any reasonable complaints as soon as reasonably practicable.

Void where prohibited

• This Prize Draw (including the promotion in relation thereto) is void where prohibited by law.

Governing law

• The Prize Draw and these terms and conditions, and any contractual or non-contractual obligations arising out of or in connection with the Prize Draw and these T&C, are governed and construed by the laws.

Jurisdiction and forum

All disputes arising out of or in connection with the Prize Draw and these T&C shall be resolved finally and exclusively by the competent court.
